1. Agreement to Terms
By engaging Idaho Bros Curb and Landscape ("Company," "we," "us," or "our") for landscaping services, you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Idaho Bros Curb and Landscape.
2. Services Provided
Idaho Bros Curb and Landscape provides professional landscaping services including but not limited to:
Full landscaping design and installation
Sprinkler system installation
Boulder placement
Concrete flatwork
Paver installation
Retaining wall construction
Water features
Sod installation
Privacy fence installation
Concrete curbing
All services will be performed in a professional and workmanlike manner in accordance with industry standards.
3. Estimates and Quotes
3.1 Free Estimates
We provide free, no-obligation estimates for all services. Estimates are valid for 30 days from the date provided unless otherwise specified.
3.2 Quote Accuracy
While we strive for accuracy, quotes are estimates based on visible conditions at the time of inspection. Final costs may vary if unforeseen conditions are discovered during project execution (e.g., underground utilities, poor soil conditions, hidden obstacles).
3.3 Quote Acceptance
A signed quote and deposit payment constitute acceptance of these terms and authorization to begin work.
4. Payment Terms
4.1 Deposit Requirements
Projects under $5,000: 25% deposit required
Projects $5,000-$15,000: 30% deposit required
Projects over $15,000: 35% deposit required
4.2 Payment Schedule
Payment schedules will be outlined in your project agreement. Typical milestones include:
Deposit upon contract signing
Progress payments at specified project milestones
Final payment upon project completion and client approval
4.3 Accepted Payment Methods
We accept cash, checks, credit cards, and electronic transfers. A 3% processing fee applies to credit card payments over $1,000.
4.4 Late Payments
Invoices are due within 15 days of invoice date unless otherwise specified. Late payments are subject to a 1.5% monthly finance charge (18% annual percentage rate) or the maximum rate permitted by Idaho law, whichever is less.
4.5 Final Payment
Final payment is due upon substantial completion of the project. Minor punch-list items will be addressed promptly but do not delay final payment obligation.
5. Project Timeline
5.1 Estimated Completion
Project timelines are estimates and depend on weather conditions, material availability, and other factors beyond our control. We will make every reasonable effort to complete projects on schedule.
5.2 Delays
We are not liable for delays caused by:
Inclement weather
Acts of God
Material shortages
Utility location delays
Permit delays
Client-requested changes
Unforeseen site conditions
5.3 Winter Work
Some services cannot be performed during winter months due to ground conditions and weather. Projects may be scheduled for completion in spring.
6. Change Orders
6.1 Scope Changes
Any changes to the original project scope must be documented in a written change order and signed by both parties before work proceeds.
6.2 Additional Costs
Changes to the project scope may result in additional costs and timeline adjustments. Change orders will specify any price and schedule modifications.
6.3 Verbal Agreements
Verbal change requests are not binding. All modifications must be documented in writing.
7. Client Responsibilities
7.1 Property Access
Client must provide clear access to work areas and ensure our crew can access the property during scheduled work hours (typically 7:00 AM - 6:00 PM, Monday-Saturday).
7.2 Utilities
Client is responsible for identifying and marking underground utilities. We recommend calling 811 (Idaho Digline) at least two business days before work begins. We are not responsible for damage to unmarked utilities.
7.3 Property Preparation
Client must remove or secure personal property, vehicles, pets, and valuables from work areas. We are not responsible for items left in work zones.
7.4 Permits
Unless otherwise specified in writing, client is responsible for obtaining necessary permits. We can assist with permit applications for an additional fee.
7.5 HOA Approval
Client must obtain any required Homeowners Association approvals before work begins. Project delays due to HOA approval processes are not our responsibility.
8. Site Conditions
8.1 Existing Conditions
We assume the property is free of hazardous materials, contaminated soil, and unmarked underground obstacles unless disclosed by client.
8.2 Unforeseen Conditions
If we encounter unexpected site conditions (rock, poor soil, underground utilities, etc.), we will notify the client immediately. Additional costs for addressing these conditions will be documented via change order.
8.3 Property Damage
We take precautions to protect your property but are not responsible for:
Damage to unmarked underground utilities
Settling or cracking of concrete due to soil conditions beyond our control
Damage to septic systems, drain fields, or leach lines not properly disclosed or marked
Damage caused by client's failure to identify sensitive areas
9. Materials and Workmanship
9.1 Material Selection
We use quality materials from reputable suppliers. Specific brands and products will be specified in your quote when applicable.
9.2 Material Substitutions
We reserve the right to substitute materials of equal or better quality if specified products become unavailable. Significant substitutions will be discussed with client.
9.3 Natural Materials
Natural materials (stone, boulders, wood) vary in color, texture, and appearance. We cannot guarantee exact color matching or uniformity in natural products.
9.4 Concrete Characteristics
Concrete may develop minor surface cracks, color variations, and settlement. These are normal characteristics and not considered defects unless they affect structural integrity.
10. Warranty
Please refer to our separate Warranty document for detailed information about our workmanship guarantee and material warranties.
11. Limitation of Liability
11.1 Maximum Liability
Our total liability for any claim arising from our services shall not exceed the total amount paid by client for the specific service giving rise to the claim.
11.2 Exclusions
We are not liable for:
Consequential, indirect, incidental, or punitive damages
Lost profits or business interruption
Damage to property not directly caused by our negligence
Acts or omissions of third-party contractors, suppliers, or service providers
Natural disasters, severe weather events, or acts of God
11.3 Insurance
We maintain general liability insurance. Certificates of insurance are available upon request.
12. Cancellation Policy
12.1 Client Cancellation
Cancellations more than 14 days before scheduled start: Full deposit refund minus $250 administrative fee
Cancellations 7-14 days before scheduled start: 50% deposit refund
Cancellations less than 7 days before scheduled start: No deposit refund
Cancellations after work has commenced: Client responsible for all work completed, materials purchased, and 25% of remaining contract value
12.2 Company Cancellation
We reserve the right to cancel any contract with full deposit refund if:
Client fails to meet payment obligations
Site conditions make the project impossible or unsafe
Client fails to provide necessary access or approvals
Client engages in abusive or threatening behavior toward our staff
13. Property Conditions After Completion
13.1 Settling and Adjustment
Newly installed landscapes require time to settle. Minor settling of soil, mulch redistribution, and plant establishment are normal and expected.
13.2 Irrigation Systems
Sprinkler systems require seasonal adjustments and regular maintenance. Client is responsible for system adjustments, winterization, and spring start-up unless separate maintenance agreement is in place.
13.3 Plant Care
Client is responsible for ongoing plant care including watering, fertilizing, and pruning. We provide care instructions but are not responsible for plant health after installation unless covered under separate maintenance agreement.
13.4 Drainage
While we design proper drainage, extreme weather events may cause temporary pooling or drainage issues. Client is responsible for yard maintenance affecting drainage (gutter cleaning, downspout extensions, etc.).
14. Dispute Resolution
14.1 Good Faith Negotiation
In the event of any dispute, both parties agree to first attempt resolution through good faith negotiation.
14.2 Mediation
If negotiation fails, parties agree to attempt mediation before pursuing litigation. Mediation costs will be shared equally.
14.3 Jurisdiction
Any legal action must be brought in Ada County, Idaho. These terms are governed by Idaho state law.
14.4 Attorney Fees
In any legal proceeding, the prevailing party is entitled to recover reasonable attorney fees and costs.
15. Intellectual Property
15.1 Design Ownership
Landscape designs and plans created by Idaho Bros Curb and Landscape remain our intellectual property. Client may not share, reproduce, or use designs with other contractors without written permission.
15.2 Photography
We reserve the right to photograph completed projects for marketing purposes. Client grants permission for use of project photos on our website, social media, and promotional materials unless client explicitly opts out in writing.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms and Conditions, along with your signed quote and any written change orders, constitute the entire agreement between client and Idaho Bros Curb and Landscape. Verbal agreements and representations not included in writing are not binding.
18. Modifications
We reserve the right to modify these Terms and Conditions at any time. Updated terms will apply to new contracts. Existing contracts are governed by the terms in effect at the time of contract signing.

By signing a service agreement or quote with Idaho Bros Curb and Landscape, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
